《用户协议》
一、用户协议的接受
1.1
本用户协议（简称“协议”）系由您与江苏曙光华阳钻具有限公司（以下简称“曙光”）所订立的相关权利义务规范，用以描述曙光通过“DSCalc-钻柱计算”软件向您提供服务及您使用“DSCalc-钻柱计算”软件服务所涉及的详细规定。因此，请您于开始使用“DSCalc-钻柱计算”软件前，认真阅读本协议的所有内容，并充分理解本协议中各条款。
1.2
只要您开始使用曙光提供的“DSCalc-钻柱计算”软件，即表示您已无条件接受了本协议的相关规定及曙光就此公布的各项管理规定，并愿意受其约束。如果发生纠纷，您应自行承担事实上未认真阅读本条款的责任，不得以未仔细阅读为由进行抗辩。
二、服务内容
2.1 “DSCalc-钻柱计算”软件是曙光提供的一款钻杆规格计算软件，曙光通过“DSCalc-钻柱计算”软件向广大用户提供便捷计算的服务（以下简称“曙光服务”）。
2.2 除非另有明确约定，“DSCalc-钻柱计算”软件增强或强化目前服务功能的所有新功能，包括新的产品以及新的服务，均自动适用本协议的约定。
2.3 您应当自行负担使用曙光服务所需的设备（例如个人手机、及其他与接入互联网或移动网有关的装置）及所需的费用（如为接入互联网而支付的电话费及上网费、为使用移动网而支付的手机费。
三、用户账号
3.1您在“DSCalc-钻柱计算”软件进行注册时，须提供真实、有效的身份识别资料，并应在前述资料发生变更时，及时进行线上更新。若您所提供的资料与事实不符或所提供的资料业已变更而未更新或有任何误导之嫌而导致曙光无法为您提供或继续提供服务的，您应自行承担由此引发的损失而与曙光无关。
3.2您须了解和认可，DSCalc-钻柱计算账号的使用权仅归属于原始注册人。未经曙光的事先书面同意，您不得以任何形式将自身DSCalc-钻柱计算账号及密码转让、赠予、出借、售卖予第三方或者以其他方式许可非初始注册人对其进行使用，否则曙光有权封禁、删除该账号。如您并非当前所使用DSCalc-钻柱计算账号的原始注册人，您应立即停止对该账号的一切使用及操作，同时曙光有权依原始注册人之请求或依自身判断将该账号重新交予原始注册人使用，由此引发的全部责任及损失与曙光无关。
3.3 您有义务妥善保管在注册时获得的账号及密码，如因黑客、第三人行为或您自身保管疏忽导致账号、密码遭他人非法使用并给您造成损失的，曙光就此不承任何责任。
3.4如您发现自身账号遭他人非法使用或有异常使用的情形，应立即通知曙光，并提供与原始注册人相一致的个人有效身份信息。曙光在核实您所提供的个人有效身份信息后，将尽可能为您维护自身合法权利提供必要协助，但曙光并不承诺您一定能通过该途径找回DSCalc-钻柱计算账号。
四、使用规则
4.1 您应就自身使用曙光服务的行为负责，并保证在使用曙光服务的过程中遵循以下原则：
（1）遵守中国有关的法律和法规；
（2）遵守本条款及曙光发布的相关管理规定；
（3）不得以任何形式侵犯第三方及曙光的合法利益；
（4）不得将曙光提供的服务用于任何非法或侵权活动，包括但不限于将其用于展示、传播包含色情、种族主义、低级趣味、淫秽、诽谤中伤、污辱性质的资料，以及传播任何针对宗教、民族传统、人种、性别、年龄的各种仇恨、歧视和偏见的内容。
4.2曙光有权对您使用服务的情况进行审查和监督，如曙光根据自身独立判断认为您存在违法或违约行为的，有权要求您纠正相应行为，并采取一切必要的措施（包括但不限于更改或删除您发布或上传的留言内容、暂停或终止您使用曙光服务的权利等）以减轻您行为造成的影响。但您确认，曙光的审查行为并不为其设置任何责任，也不免除您的任何义务。
4.3 您应保证自身对“DSCalc-钻柱计算”软件的使用行为的合法性、正当性，且不得对客户端进行反编译、反汇编、破解等行为。
4.4请勿滥用或干扰DSCalc-钻柱计算软件服务，包括但不限于将DSCalc-钻柱计算软件服务用于非法目的，篡改与DSCalc-钻柱计算软件相关的计算机代码，使用与曙光、DSCalc-钻柱计算相关的标志或文字，攻击曙光的服务器，删除、隐藏或修改任何与DSCalc-钻柱计算软件服务相关的声明等。
4.5 如果曙光根据自身独立判断认为您对曙光的使用超出了合理范围，我们有权对您就曙光服务的使用进行限制，您应自行承担由此引发的责任及损失。
五、服务变更、中断与终止
5.1 曙光所提供的服务存在因包括不可抗力、计算机病毒或黑客攻击、系统不稳定、您所在位置、通信线路、曙光自身运营调整、合作伙伴调整等因素造成的服务中断或不能满足您要求的风险。
5.2 曙光可能随时变更、中断或终止部分或全部的服务且无需另行对您进行通知，请注意定期对您存放在曙光网络服务上的数据进行备份，以避免损失。
5.3 如您欲使用曙光提供的服务，须承担以上风险，曙光对您或任何第三人由此遭受的损害均不承担赔偿责任。
六、法律适用和争议解决
本协议的解释、效力及纠纷的解决，适用于中华人民共和国（不包括港澳台地区）法律。因使用曙光服务产生的或与此相关的纠纷，曙光及您均有权将其提交至广州市番禺区仲裁委员会通过仲裁方式解决。仲裁裁决是终局的，对各方均有约束力。
七、本协议的变更和修改
7.1为了更好地服务用户，曙光有权随时对本协议进行修改，并且一旦发生协议条款的变更，曙光将在相关页面上提示修改的内容；您如果不同意本协议的修改，应当立即停止使用曙光服务；如果您选择在本协议变更后继续使用曙光服务，则视为您已经接受并愿意遵守本协议的修改。
7.2如果用户对本协议的任何条款表示异议，可以选择不安装或使用曙光及DSCalc-钻柱计算其相关服务。用户的注册、登录、使用曙光及DSCalc-钻柱计算及其相关服务的行为将视为对本协议的接受，同时视为用户同意按照本协议约定的方式使用DSCalc-钻柱计算。
八、账号注销及账号注销处理时效
8.1 您可以进入“个人中心”，点击“注销账号”来注销账号，请您仔细阅读文字提示，并在同意后开始注销。
8.2 请您知悉，账号注销处理时效为即时。我们将即时删除您的个人信息。
8.3 您注销账号的行为是不可逆的，一旦您的账号被注销，我们将不再收集您的个人信息，也不再为您提服务；该账号下的内容、信息等将会被删除，除非法律法规另有规定或监管部门另有要求。因此我们建议您谨慎选择注销账号。
User agreement
1、 Acceptance of user agreement
1.1
This user agreement (hereinafter referred to as "agreement") is the relevant rights and obligations
specification entered into between you and Jiangsu Shuguang Huayang Drilling Tool Co., Ltd. (hereinafter
referred to as "Shuguang"), which describes the detailed provisions involved in Shuguang's provision of
services to you through the "drill string calculation software" software and your use of the "drill
string calculation software" software services. Therefore, please carefully read all the contents of
this Agreement and fully understand the terms of this agreement before using the "drill string
calculation software".
1.2 as long as you start to use the "drill string calculation software" provided by Shuguang,
it means that you have unconditionally accepted the relevant provisions of this Agreement and the
management provisions announced by Shuguang, and are willing to be bound by them. In case of any
dispute, you shall bear the responsibility for not carefully reading this clause in fact, and shall not
defend on the ground of not carefully reading it.
2、 Service content
2.1 "drill string calculation software" is a drill pipe specification calculation software
provided by Shuguang. Shuguang provides convenient calculation services to users through "drill string
calculation software" (hereinafter referred to as "Shuguang service").
2.2 unless otherwise expressly agreed, all new functions of "drill string calculation
software" software to enhance or strengthen the current service functions, including new products and
new services, shall automatically apply to the provisions of this agreement.
2.3 you shall bear the equipment (such as personal mobile phones and other devices related to
access to the Internet or mobile network) and expenses (such as telephone fees and Internet access fees
paid for access to the Internet and mobile phone fees paid for use of the mobile network) required for
the use of Dawning service.
3、 User account
3.1 when you register the "drill string calculation software", you must provide real and effective
identification data, and timely update the above data online in case of change. If the information you
provide is inconsistent with the facts, or the information you provide has been changed but not updated,
or there is any suspicion of misleading, resulting in Shuguang's inability to provide or continue to
provide services for you, you shall bear the losses caused by this, which has nothing to do with
Shuguang.
3.2 you must understand and recognize that the right to use the drill string calculation software
account only belongs to the original registrant. Without the prior written consent of Shuguang, you
shall not transfer, give, lend, sell your own drill string calculation software account and password to
a third party in any form, or otherwise license the non initial registrant to use it, otherwise Shuguang
has the right to block and delete the account. If you are not the original registrant of the currently
used drill string calculation software account, you shall immediately stop all use and operation of the
account. Meanwhile, Shuguang has the right to re hand over the account to the original registrant at the
request of the original registrant or at its own judgment. All liabilities and losses arising therefrom
have nothing to do with Shuguang.
3.3 you are obliged to properly keep the account and password obtained at the time of
registration. If the account and password are illegally used by others and cause losses to you due to
the acts of hackers, third parties or your own negligence, Shuguang will not bear any responsibility.
3.4 if you find that your account is illegally used or abnormally used by others, you should immediately
notify dawn and provide personal valid identity information consistent with the original registrant.
After verifying the personal valid identity information provided by you, Dawning will provide necessary
assistance for you to safeguard your legal rights as much as possible, but dawning does not promise that
you will be able to retrieve the drill string calculation software account through this way.
4、 Use rules
4.1 you shall be responsible for your use of Dawning services and ensure that the following
principles are followed in the process of using dawning services:
（1) Abide by relevant Chinese laws and regulations;
(2) Comply with these terms and relevant management regulations issued by dawning;
(3) Shall not infringe upon the legitimate interests of third parties and dawn in any form;
(4) The services provided by dawning shall not be used for any illegal or infringing activities,
including but not limited to displaying and disseminating materials containing pornography, racism, low
taste, obscenity, slander and insult, as well as disseminating any content of hatred, discrimination and
prejudice against religion, national tradition, race, gender and age.
4.2 dawning has the right to rediv and supervise your use of the service. If dawning believes that you
have violated the law or breach of contract according to its own independent judgment, it has the right
to require you to correct the corresponding behavior and take all necessary measures (including but not
limited to changing or deleting the message content published or uploaded by you, suspending or
terminating your right to use the dawning service, etc.) To mitigate the impact of your behavior.
However, you confirm that dawning's rediv does not set any responsibility for it or exempt you from any
obligation.
4.3 you shall ensure the legality and legitimacy of your use of the "drill string calculation
software" software, and shall not decompile, disassemble and crack the client.
4.4 do not abuse or interfere with the drill string calculation software service, including but not
limited to using the drill string calculation software service for illegal purposes, tampering with the
computer code related to the drill string calculation software, using the signs or words related to
dawning and drill string calculation software, attacking the dawning server, deleting Hide or modify any
statements related to drill string calculation software services, etc.
4.5 if dawning believes that your use of Dawning exceeds the reasonable range according to
its own independent judgment, we have the right to restrict your use of Dawning services, and you shall
bear the responsibilities and losses arising therefrom.
5、 Service change, interruption and termination
5.1 there are risks of service interruption or failure to meet your requirements due to factors such as force majeure, computer virus or hacker attack, system instability, your location, communication line, Dawning's own operation adjustment, partner adjustment and so on.
5.2 dawning may change, interrupt or terminate part or all of the services at any time without further notice to you. Please pay attention to regularly backup the data stored on Dawning network services to avoid losses.
6.3 if you want to use the services provided by Shuguang, you must bear the above risks, and Shuguang will not be liable for the damages suffered by you or any third party.
6、 Application of law and dispute resolution
The interpretation, validity and dispute settlement of this Agreement shall be governed by the laws of the people's Republic of China (excluding Hong Kong, Macao and Taiwan). Any dispute arising from or related to the use of Dawning services, dawning and you have the right to submit it to Guangzhou Panyu District Arbitration Commission for arbitration. The arbitration award is final and binding on all parties.
7、 Changes and amendments to this Agreement
7.1 in order to better serve users, Dawning has the right to modify this agreement at any time, and once the terms of the agreement are changed, Dawning will prompt the modified content on the relevant page; If you disagree with the amendment of this agreement, you shall immediately stop using dawning service; If you choose to continue to use dawning service after the change of this agreement, it shall be deemed that you have accepted and are willing to abide by the amendment of this agreement.
7.2 if the user disagrees with any provision of this agreement, he can choose not to install or use dawning and drill string calculation software and its related services. The user's registration, login, use of dawning and drill string calculation software and related services will be deemed as acceptance of this agreement, and it will be deemed that the user agrees to use the drill string calculation software in the manner agreed in this agreement.
8、 Account cancellation and account cancellation processing time limit
8.1 you can enter the "personal center" and click "Cancel Account" to cancel the account. Please read the text prompt carefully and start cancellation after you agree.
8.2 please know that the time limit for account cancellation is immediate. We will delete your personal information immediately.
8.3 your cancellation of your account is irreversible. Once your account is cancelled, we will no longer collect your personal information or provide services for you; The contents and information under the account will be deleted unless otherwise specified by laws and regulations or required by regulatory authorities. Therefore, we recommend that you carefully choose to cancel your account.
